“I disapprove of what you say, but I will defend to the death your right to say it.”
While that quote is often misattributed to Voltaire, it’s not that far off. In fact, the words come from a biography of the French philosopher written by Evelyn Beatrice Hall wherein the author tried to encapsulate Voltaire’s beliefs.
Though a Frenchman, Voltaire’s beliefs certainly influenced the American Revolutionand helped shape the United States as we know it. In fact, his influence on the formation of the country is immediately apparent: “Congress shall make no law… abridging the freedom of speech,” reads the First Amendment of the Bill of Rights.
Of course, over the years, the Supreme Court has abridged that amendment, if not the spirit behind it. Some highlights include:
- Schenck v. United States – In 1919, the court ruled that speech could be limited if that speech resulted in a “clear and a present danger” that encouraged the use of force. (That ruling was augmented 50 years later in Brandenburg v. Ohio when the court decided such threats had to be imminent.)
- Chaplinksy v. New Hampshire – In 1942, the court ruled that “fighting words” – i.e., words that are cause a breach of the peace – were not protected.
- Virginia v. Black – In 2003, the court ruled that speech directed at people that ostensibly results in putting them at risk for bodily harm is not protected. However, in Watts v. United States (1969), the court ruled that if the party the speech was directed at understood the hyperbole in the speech, it is protected as it’s not a real threat, per se.
So while we enjoy a freedom of speech in America, we certainly do have limitations to that speech. You can’t yell “BOMB!” in a movie theater, for example.
Freedom of Speech in the Digital Age
It appears as though we’re on the precipice of the court weighing in on another monumental case that will almost certainly redefine our First Amendment once again.
The question before the court is simple: When does an instant message or a tweet become a threat? Better yet, does it even become a threat at all?
Meet Anthony Elonis, a Pennsylvania man who took to his Facebook page to vent about his estranged wife. Of course, that venting could certainly be interpreted to be scary, and even violent, by some. Case in point? Here’s a snippet from one of the posts:
There’s one way to love ya, but a thousand ways to kill ya,
And I’m not going to rest until your body is a mess,
Soaked in blood and dying from all the little cuts.
Hurry up and die, bitch.
If you can believe it, that’s actually among the less graphic excerpts, but you get the point.
Elonis’ wife eventually got scared and obtained a restraining order against him. But Elonis’ digital abuse didn’t stop there. In fact, he kept going and going and going, reciting rap lyrics written in the same vein as Eminem on his Facebook page. It’s important to note, however, that Elonis sprinkled in disclaimers on his Facebook page, telling friends that he was just venting and not to take anything seriously.
A jury of his peers, however, didn’t agree that Elonis was just playing around; he was sentenced to 44 months in prison under a federal threat statute.
But the case is under appeal, so we’ll soon find out whether the Supreme Court feels that Elonis was operating within his constitutionally protected rights when he took to social media to “vent.”
So, What’s Next?
What would happen if Elonis wrote his words down in a notebook and gave that notebook to friends to read? Chances are there wouldn’t be anywhere near the uproar we’ve seen.
Yet that’s essentially what he did – just in the digital world. His wife, after all, never has to go to his Facebook page to see what he’s saying about her. Sure, there’s curiosity there – either on her part or on the part of her friends – which is certainly why she ended up finding out about his postings in the first place.
But the fact that Elonis was arrested and put in jail makes you wonder how people like Eminem get away with it, rapping about killing his ex-wife and just about anyone else, for that matter. Eminem’s lyrics are shared publicly, so an argument can be made that both of these men vented their demons in the same exact manner.
People are idiots. There are endless stories of people posting stupid statements on social media and regretting them almost instantly. There are also instances of people posting unfounded threats, and at the end of the day, being embarrassed and remorseful.
Elonis should certainly have been investigated because of his posts and actions. But at the end of the day, after that investigation didn’t uncover any nefarious plots to actually murder his estranged wife, the police should have washed their hands and been done with it.
So long as someone’s speaking in the comfort of their own home without any plans of committing any crimes, no crimes have been committed.
Sure – maybe it’s unfortunate that we can’t throw idiots in jail. But if we start arresting everyone for saying stupid things on the Internet, you and I and everyone we know would almost certainly end up behind bars.
A new color-coded map shows just how much reach your favorite NFL team has across the United States. Basically, the odds are good that you’re surrounded by like-minded football fanatics — unless your team happens to be the New York Jets.
The map shows which counties various football fans live based on which NFL team they “Like” on Facebook. Based on the data, the New York Jets are only NFL team that failed to win over a single county.
I am a Jets fan!
And I’m proud to be a Jets fan!
My daughter is a Jets fan too!
I even have a friend who’s a Jets fan! Really!
Then there’s this guy:
And not for nothing, but the Jets are sold out. Every game.
Unlike say, the Bills.
So c’mon Jets fans. Get those Facebook “Likes” in gear. Show that other team how Met Life Stadium is our stadium too. No matter what some silly map says.
Now, repeat after me:
J – E – T – S, Jets! Jets! Jets!
I think auto-play videos are one of the great menaces of social media. I try to avoid them whenever possible. However, Facebook has been using them as a feature, not a flaw. These can be annoying on a PC, but they can be hazardous to data plans when on mobile devices. So, here is a video showing you how to turn off those pesky auto-play videos…
I know I’ve been on this anti-Facebook roll as of late. I would stop if Facebook would stop being so annoying.
If you use your Facebook app on your phone or tablet, you’re going to be confronted with a choice. Facebook will soon be releasing an update that renders your app incapable of sending messages to other users. Instead, you’ll have to use their messenger app. However, that app basically takes over your device. Here is more on the overly intrusive app.
If you’re anything like your neighbor…you probably use Facebook on your phone WAY more than you use it on a computer. You’ve been sending messages from the Facebook app and it probably always asks you if you want to install the Facebook Messenger App.
It’s always been OPTIONAL but coming soon to your Facebook experience….it won’t be an option…it will be mandatory if you care to send messages from your phone.
No big deal one might think…but the part that the average Facebook User doesn’t realize is the permissions you must give to Facebook in order to use the Facebook Messenger App. Here is a short list of the most disturbing permissions it requires and a quick explanation of what it means to you and your privacy.
Change the state of network connectivity – This means that Facebook can change or alter your connection to the Internet or cell service. You’re basically giving Facebook the ability to turn features on your phone on and off for it’s own reasons without telling you.
Call phone numbers and send SMS messages – This means that if Facebook wants to…it can send text messages to your contacts on your behalf. Do you see the trouble in this? Who is Facebook to be able to access and send messages on your phone? You’re basically giving a stranger your phone and telling them to do what they want when they want!
Record audio, and take pictures and videos, at any time – Read that line again….RECORD audio…TAKE pictures….AT ANY TIME!! That means that the folks at Facebook can see through your lens on your phone whenever they want..they can listen to what you’re saying via your microphone if they choose to!!
Read your phone’s call log, including info about incoming and outgoing calls – Who have you been calling? How long did you talk to them? Now Facebook will know all of this because you’ve downloaded the new Facebook messenger app.
Read your contact data, including who you call and email and how often – Another clear violation of your privacy. Now Facebook will be able to read e-mails you’ve sent and take information from them to use for their own gain. Whether it’s for “personalized advertisements” or if it’s for “research purposes” ….whatever the reason..they’re accessing your private encounters.
Read personal profile information stored on your device – This means that if you have addresses, personal info, pictures or anything else that’s near and dear to your personal life…they can read it.
Get a list of accounts known by the phone, or other apps you use – Facebook will now have a tally of all the apps you use, how often you use them and what information you keep or exchange on those apps.
Frankly, the only other information that this app could collect is when you pass gas. It’s that bad.
As for myself, I have set my apps to not update unless I give permission, and will try to keep the current version. I had used the messenger app before (about a year or so ago). I had uninstalled it, because it was a memory hog, and made the phone act weird. If worst comes to worst, I just wont send messages if I can’t be at my desktop.
I think this is what happens when a company gets so big, that they think they can force their customers to do what ever they want. However, that does not mean that we have to play along. If it comes down to it, I will find another app to message with, and I’ll simply not use Facebook when I’m not at a PC.
UPDATE: Even though I did not allow my Facebook app to update, it somehow killed the messenger part of it. Not only that, the app doesn’t allow me to uninstall updates. So, don’t be offended if I don’t return a message on Facebook, because I will not be downloading that Messenger app. So, to Facebook, I say…
With everyone being so privacy minded these days, you might want to manage, when possible, the data on searches that companies keep on you. With that in mind, here are some instructions to delete search data from Facebook, via Kim Komando…
To clear past searches, log in to Facebook and go to the gear icon in the top right. Click on the Activity Log button to the upper right. The Activity Log is where Facebook tracks your actions across the service.
On the left column of the Activity Log, under Photos, Likes and Comments, click on the More link. Then scroll down and click on the Search link.
You’ll see a list of every Facebook search you’ve ever made, organized by date. You can clear searches individually by clicking the crossed-circle icon on the right.
To clear every search, click on the Clear Searches link located at the top-right of the list. A pop-up box will ask you to confirm the request. Click the Clear Searches button.
Your search history should now be cleared. Simple!
Privacy is on the mind of most everyone. With companies trying to tailor ads for you, or selling your data, to creepy stalkers that want to make it legal to for adults to have sex with kids, you owe it to yourself and your loved ones to make your personal information as difficult to find as possible.
Leave it to SooperMexican, with a notable assist from the Morlock Revolt, to find President Obama’s Facebook “Look Back Video.” Here it is, in all it’s glory…
Thanks again to SooperMexican, and the Morlock Revolt, for bringing this important “Look Back Video” to the world.
As we all know, democrats, or progressives, or socialists, are so very, very, tolerant. Their tolerance knows no depths, until, that is, someone disagrees with their agenda. Then, for some
strange unknown reason, hypocrisy, they become the most intolerant creatures of ever walked the earth. The latest example of this comes from New Hampshire, where Republican Marilinda Garcia is considering a run for Congress.
Ms. Garcia is very attractive and is reportedly equally conservative, and as we covered before, local Democrats had to rush out to attack her. Because, as we all know, is the evil Republicans that are waging a war on women, right? For their latest active tolerance, Democrats decided to help Marilinda Garcia by creating a Facebook page for. They were so incredibly thoughtful, but they decided to attribute quotes from Hitler to her. America’s Watchtower as more…
New Hampshire Democrats are scared to death of Marilinda Garcia; so afraid that they viciously attacked her on Twitter almost immediately after she announced she would seek the Republican nomination to face off against ultra-moonbat Ann Kuster.
But apparently the New Hampshire Democrats did not think that attack went far enough so they created a fake Marilinda Garcia Facebook page complete with Adolf Hitler quotes which they attributed to Marilinda Garcia. This is beyond despicable, they have reached a new low–if that is possible.
Here is what her spokesman had to say:
Brad Stevens, a campaign spokesman for Garcia, called the “crude fake social media account” a disappointment in the candidate’s early campaign.
“Marilinda hasn’t been an announced candidate for Congress a full two weeks and she has already been the subject of multiple personal attacks,” he said in an email. “But Marilinda knows the struggles facing New Hampshire families of losing health insurance due to ObamaCare regulations, sluggish job growth and burdensome debt are the real issues that need to be front-and-center in this campaign and not dirty political attacks.”
in the end, this is yet another example of how the Democrats operate. Their candidate is on record as supporting Obama care, which is cause people to lose hours at their jobs, lose their healthcare plans, forces them to purchase more expensive plans to give them less, it is cost people their jobs. They cannot possibly debate Marilinda Garcia on the facts, so they have to smear her to keep their low information voters on the plantation.
Just remember, it’s the Republicans that hate women, right?
Hey all, I hope everyone had a great Thanksgiving, I visited with family for a few days. So, I’m rejuvenated. Well, I’m back, and it’s time for the links and pics.
Another week has gone by? Yes, yes it has. This week was still filled to the gills with ObamaCare damage posts, and it’s the curse that keeps on cursing. We also saw that Obama was willing to be conned by the Iranians, but at least he got to throw the Israelis under the bus. We saw more examples of the normalization of pedophilia, and we got a treasure trove of information regarding the #FreeKate movement. However, that will be coming out over the next few days.
As for the week’s links, the collection is extensive. The Facebook friends pics are there as well. so take a few minutes and enjoy!
Fab Food Friday Fotos: Oven BBQ Ribs, Colombian Potato Stew, Pumpkin Pecan Granola, Split Pea Soup, Fish Pie with Smoked Cheese Topping, Ven Pongal, Princess Barbie Doll Cake, Shrimp Fried Rice & Potstickers, More Easy Recipes
There you have it folks. Thanks for reading, and be sure to stop back during the week!
Sorry for the late start on this week’s post, but it’s been a busy time here at the bunker. Lots of church related things going on, which is always good, plus the holidays are coming.
ObamaCare continues to train-wreck in slow motion. I find it ironic that many democrats are now advocating for the exact course of action that they vilified Ted Cruz and Mike Lee for just a month ago. Remember that government shu8t down the democrats planned…over ObamaCare? Yeah, just about that.
We’ve seen an escalation of stalking behavior from a handful of #FreeKate supporters. Apparently, when they aren’t trying to legalize sex with minors, they are systematically stalking opponents. In once case they have claimed to have contacted people in one critic’s community members, police department, and have even threatened to harass her’s disabled veteran husband. As long as their actions are newsworthy, they will be covered here. Bullies win if good people are silenced, and I’m not one to cower before bullies.
We’re covering a lot here as of late. We have the ObamaCare debacle. We also are talking extensively about the lies and excuses they are using to justify ObamaCare. There are stories on the normalization of pedophilia, which should alarm any parent. That, and the attacks against Christians are also on the rise. We’ll continue to cover these, and any other newsworthy items.
At any rate, here are your links, as well as pics stolen from my Facebook friends. Enjoy!
There you have it. I hope all of you had great weekends, and please stop back during the week for more Conservative news and views!
Oh, and you can do all of your Christmas shopping here at the CH 2.0!
How much can the Obama administration lie? They lied, for years, about ObamaCare; knowing that millions people were going to lose their plans. Then, when they were caught, they changed the lie, and and are doing it some more. It shows the pathology that exists in our political system, and it is the rule, not the exception.
Speaking of pathology, the #FreeKate supporters are at it again, falsely reporting truth tellers to Twitter for spam, and openly discussing it. Then again, honesty has never been embraced by #FreeKate, and considering they want to make it legal for adults to have sexual contact with minors, we can’t really expect much in the ethical or moral department, can we? Both Stacy McCain and myself covered that on Saturday…
So, it appears that as long as there are people active in the “Jailbait Liberation Movement, we’re going to have issues. After all, interfering with their ability to have sex with young teens is “hate!”
At any rate, these, and other stories are not going away. Politicians are going to lie, and perverts are going to want to legalize jailbait, so we’re not going without writing material! But this post is about links and pics, so here you are. The links are outstanding this week, as are the Facebook friend pics. Enjoy!
Fab Food Friday Fotos: Christmas Chex Mix & Cookies, Beef Potato Stew, Egg Fried Rice, Pumpkin Soup, Smoked Salmon, Strawberry Jam, Homemade Horseradish, Pork Chops & Gravy, Vegan Vanilla Ice Cream, Baked “Grilled” Chicken, More Cheap Recipes
There you have it. I hope you enjoyed. keep on checking back in each week for more Conservative news and views.
Update: Larry Jackson, from Political Realities, has noted that his link is missing., That it is, and that is deplorable, as Larry is a great supporter of the CH 2.0. Here are some links to make up for the loss…
Hello all, it’s Sunday again, and we need to say thanks to all who link the CH 2.0 by giving them some links, and throwing in some pics posted by my Facebook friends. But before we get started, let’s go over some recent changes here at the CH 2.0.
1. The Disqus Commenting system seems to have been well received, and the page is loading far more quickly.
2. I haven’t received any feedback as of yet, but I have added some plugins to correct the pinging and trackback problems. Please let me know in the comments if you got a trackback from this post.
3. I’ve vastly upgraded the security here. You’ll not see the difference, but it’s there.
So, enjoy your visit!
There you have it, everyone. I hope you enjoyed the humble post. Keep on coming back during the week for more Conservative news and views.
Once again, it’s been a banner week. The ObamaCare roll-out continues to be an abject failure, and even the MSM can’t ignore that millions of Americans are losing their coverage and that the ObamaCare approved alternatives often cost much more. As usual, the Democrats are desperately trying to blame someone or something else, but it’s slow going.
At any rate, here are your links, as well as some pics from my Facebook friends…
Good Morning! I hope everyone is having a good weekend. Things at the CH 2.0 bunker have been busy and productive. I wish I could say the same about Congress, who capitulated to President Brat at the Spite House. And, of course, I had to watch the RINO’s, once again, act like “Democrats Lite.” Alsop, the MSM lied about the shutdown, and ignored material evidence that the Democrats had planned it months ago.
Then, the complete failure of ObamaCare continued as well. And, of course, the MSM largely ignored it. But, as always we did not.
So, here are your links, along with some pictures “borrowed” from my Facebook friends.
Well, there you have it. Thanks to all that visit and comment, and we’ll be back next week.
Well, it’s been a pretty interesting couple weeks. For the first time in a very long time, there was no link post this week. I was busy with other things, including the #FreeKate investigation, so I wasn’t available to get the post up and out. Also, the democrat shutdown and the related drama, including the many epic failures of ObamaCare kept me from the racial violence posts. So, I will be trying to get back on track this week, provided that the Hunt family and their supporters stop threatening people.
So, getting back to the traditional format, here are your weekly links, as well as some pictures stolen from my Facebook friends…
Enjoy the rest of your weekends, and celebrate the first victory for the Steelers this season!
Apparently, Facebook did not like the “Truckers to Shut Down America” page, as it no longer exists. Freedom Outpost has more on the situation…
As reported yesterday, the Facebook page for Truckers to Shut Down America was experiencing difficulties with the Facebook powers when the admins of the page were banned for using “God Bless America.” Today, that Facebook page is gone. I reported yesterday that a website, ridefortheconsitution.org, has been established to promote this event.
Other Facebook pages have appeared such as the one for the Canadian truckers to shut down as well and/or drive to Toronto; it is still up. The Facebook page, Citizens in Support of the Washington Trucker Convoy, established on September 18, is still up and running with only 513 likes.
Dean Garrison at The DC Clothesline has also reported being unable to find the Facebook page, Truckers to Shut Down America.
So, let me see if understand this. Facebook will allow pages promoting jihad, Islamist ideas and any other foul disgusting thing you can think of but will pull pages like Truckers to Shut Down America and Uncle Sam’s Misguided Children for promoting conservative and/or Christian beliefs. That makes sense when the owners and admins of Facebook are in cahoots with government and in bed with big money men.
That’s the current state of the situation. Mr. Conservative has even more…
Here is more information from the group’s Facebook page (the one that got pulled from the web):
My fellow patriot this effort is to support the truckers in a major shut down of America ion [sic] a 3 day strike October 11th thru 13th. Obamacare will be in effect and most people will be ready to take action. No commerce on those days stock up on items that you will need. No banking no shopping no money transactions.
It does not matter if a million or 50 roll through DC in this effort. Congress will listen to We the People. Which is remove Obama from office for crimes of treason and misdemeanors. We want Congressional hearing on Benghazi and Seal Team 6. Louis Learner [sic] put in jail. No amnesty, remove all Muslims in our government that do not uphold the Constitution. Remove Eric Holder from office for crimes against the people and the Constitution. Last but not least is Fuel prices.
Do you support these truckers?
So, it’s still on, even though Facebook allegedly dislikes “God Bless America.”
This will be a quick post. The #FreeKate Facebook page was shut down last night. It was said to have been hacked. I have details, but for some rather good reasons, screencaps cannot be shared at this time. There is a new page, “Kate’s Fight,” and the equivalent #KatesFight hashtag.
Much information has come to light in the last 24 -48 hours. I had a post ready to go for noon today, but I am declining to publish it at this time. I am working actively on this story, but not in a way that will be immediately obvious. I will do posts on this topic when there are significant events, but I am not publishing my typical “#FreeKate as a liberal movement” posts at this time.
I know, I’m being cryptic, and I frankly hate when others do that. However, in the end, the reason for my hypocrisy will be clear.
